These Terms of Service ("Terms") govern your use of the SimploMail Inbox service ("Inbox" or the "Service") provided by 1048035 B.C. LTD., doing business as SimploMail ("SimploMail", "we", "us", or "our").
By creating an account, purchasing an Inbox subscription, or using the Service, you agree to these Terms. If you do not agree to these Terms, you may not use the Service.
If you use the Service on behalf of a company, organization, or other legal entity, you represent that you have the authority to accept these Terms on its behalf. In that case, "you" includes that entity.

2. Eligibility
You must be at least 16 years old to use Inbox.
By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
If you use Inbox on behalf of a business or organization, you represent that you are authorized to bind that organization to these Terms.
3. What the Inbox Service Provides
SimploMail Inbox is an Email Address service.
The Service allows you to use an email address associated with a domain that you own or are authorized to use.
Inbox provides the email infrastructure necessary to:
- receive email messages sent to your Inbox email address;
- send email messages from your Inbox email address;
- process messages while they are being received, sent, or delivered; and
- temporarily store messages as necessary to perform these functions.
Inbox is not an email hosting service, email archival service, or email backup service.
SimploMail does not provide permanent storage of your email messages.
Messages are stored on SimploMail infrastructure only temporarily as necessary to process and deliver them. Once a message has been successfully delivered to its intended recipient or successfully retrieved by the applicable email client or email system, SimploMail may remove its copy.
Features and technical details of the Service may change from time to time.
4. Email Clients and Applications
You may use compatible email clients, applications, or devices to send and receive messages using your Inbox email address.
You are responsible for configuring and maintaining your email client and devices.
SimploMail is not responsible for problems caused by:
- incorrect email client configuration;
- unsupported email applications;
- problems with your device;
- third-party software;
- Internet connectivity;
- operating-system changes; or
- third-party services.
Your use of a third-party email client or application may also be subject to that provider's own terms and privacy policies.
5. Account Registration
You may need to create a SimploMail account to use Inbox.
You agree to provide accurate and current information when creating and maintaining your account.
You are responsible for keeping your account information current.
You are responsible for protecting your account credentials and for activity performed through your account.
You must notify SimploMail if you believe that your account has been compromised or accessed without authorization.
We may require additional information or verification before activating an account, domain, or email address.
6. Domain Ownership and Authorization
You may only use Inbox with a domain that you own or are authorized to administer.
You are responsible for having the necessary rights and authority to use the domain and any email address associated with it.
We may require you to verify control of a domain before allowing it to be used with the Service.
You must not use a domain or email address without authorization.
If we reasonably believe that you do not control or have authorization to use a domain, we may suspend or remove that domain or associated email addresses.
7. Email Addresses
SimploMail provides an email address to you for use during your active subscription.
You do not acquire ownership of the email address itself merely by subscribing to the Service.
An email address may become unavailable if:
- you cancel your subscription;
- your subscription expires;
- payment is not received;
- your account is suspended or terminated;
- the associated domain is no longer authorized; or
- the email address presents a security, abuse, fraud, or operational risk.
We do not guarantee that an email address will remain available after your subscription ends.
You are responsible for updating your email address with websites, services, customers, contacts, and other third parties before cancellation or termination.
8. Your Email Content
You retain ownership of the email messages and other content that you send or receive through Inbox, subject to the rights of other persons who may have rights in that content.
You grant SimploMail a limited, non-exclusive right to process, transmit, temporarily store, copy, and otherwise handle your content as reasonably necessary to:
- provide the Service;
- receive and send email;
- process and deliver messages;
- provide technical support;
- maintain and secure our infrastructure;
- detect and prevent spam, abuse, fraud, and malware;
- troubleshoot technical problems;
- comply with legal obligations; and
- enforce these Terms.
This permission does not give SimploMail ownership of your content.
9. Acceptable Use
You may use Inbox only for lawful purposes and in accordance with these Terms.
You must not use the Service to:
- send spam or unsolicited bulk email;
- send phishing messages;
- conduct scams or fraud;
- impersonate another person, company, organization, or service;
- obtain passwords, authentication credentials, financial information, or other sensitive information through deception;
- distribute malware, viruses, ransomware, spyware, or other malicious software;
- send malicious links or harmful attachments;
- unlawfully harass, threaten, or abuse other people;
- violate applicable laws or regulations;
- infringe another person's intellectual-property or other legal rights;
- operate an unauthorized open relay;
- attempt to bypass SimploMail security controls;
- gain unauthorized access to SimploMail systems or another person's account;
- scan, probe, attack, or interfere with SimploMail infrastructure;
- interfere with the normal operation of the Service;
- deliberately damage the reputation or email deliverability of SimploMail;
- use the Service to facilitate unlawful activity;
- resell the Service without our written authorization; or
- assist another person in carrying out prohibited activity.
We may take action against activity that creates a significant risk to our customers, infrastructure, email reputation, or other users even if the specific activity is not listed above.
Receiving unwanted email through your Inbox address does not, by itself, violate these Terms. These restrictions primarily concern the use of the Service to send, transmit, or facilitate prohibited activity.
10. Commercial Email and Anti-Spam Laws
You are responsible for complying with all laws and regulations that apply to email messages you send using Inbox.
If you use Inbox to send commercial, promotional, or other regulated electronic messages, you are responsible for determining which legal requirements apply to those messages.
Depending on the applicable law, those requirements may include obtaining consent, identifying the sender, providing required information, maintaining records of consent, or providing an unsubscribe mechanism.
SimploMail Inbox is an Email Address service. It does not provide email marketing or subscriber-management functionality.
SimploMail does not determine whether a particular message requires consent, an unsubscribe mechanism, or other legal disclosures.
You are solely responsible for obtaining any consent required by law and for including any information, notices, or mechanisms required by the laws applicable to your communications.
Your use of Inbox does not transfer your legal obligations as a sender to SimploMail.
11. Spam, Abuse, and Security Controls
We may use automated systems and, where reasonably necessary, human review to detect and respond to spam, phishing, malware, fraud, unauthorized access, and other security or abuse risks.
This may include analyzing technical information such as:
- message headers and metadata;
- sending and connection patterns;
- authentication information;
- delivery failures;
- bounce activity;
- abuse reports;
- malware indicators;
- malicious links;
- unusual account activity;
- domain configuration; and
- security events.
We do not have an obligation to monitor every message or account.
We may block, delay, reject, quarantine, or otherwise restrict messages or account activity when reasonably necessary to protect SimploMail, our customers, recipients, third parties, or email infrastructure.
12. Temporary Message Storage
Inbox temporarily stores email messages on SimploMail infrastructure when necessary to receive, process, route, or deliver them.
Messages may temporarily exist in mail queues, processing systems, active storage, caches, backups, logs, security systems, or other operational systems.
The length of time a particular message remains in any system may vary depending on the message, delivery status, system operation, and other technical circumstances.
When a message has been successfully delivered to its intended recipient or successfully retrieved by the applicable email client or email system, SimploMail may remove its copy from the active systems used to process the message.
If delivery cannot be completed, a message may remain temporarily while delivery is attempted or while the Service processes the delivery failure.
We do not guarantee a specific retention period for messages.
13. Inbox Is Not Email Storage or Backup
Inbox is designed to provide an email address and to send and receive email messages.
It is not designed to provide permanent storage, email archiving, or backup.
You should not use Inbox as your only copy of important email.
If you need to preserve an email message, you are responsible for keeping your own copy using your email client, device, or another storage or backup service.
SimploMail does not guarantee that a particular message can be recovered after it has been removed from our active systems.
14. Email Delivery
Email delivery depends on systems operated by SimploMail and by third parties.
We do not guarantee that a message will:
- be accepted by the recipient's mail server;
- be delivered to the intended recipient;
- arrive within a particular period of time;
- appear in the recipient's inbox;
- avoid spam or junk folders;
- remain available after delivery; or
- be preserved without loss.
Recipient mail servers, email providers, Internet service providers, spam filters, DNS configuration, network conditions, domain reputation, and other systems may delay, reject, filter, or otherwise affect email.
SimploMail is not responsible for actions taken by recipient systems or other third parties.
15. Email Delivery Failures
If a message cannot be delivered, SimploMail may attempt delivery again for a limited period or may return a delivery failure notification, depending on the circumstances.
We do not guarantee that every failed message will be retried or that every delivery failure will generate a particular type of notification.
Temporary message storage does not constitute a guarantee that an undelivered message will remain available indefinitely.
16. Privacy and Access to Email
Your use of Inbox is also subject to our Privacy Policy.
We do not sell your email content for advertising purposes or use your email content to train artificial intelligence models.
Limited access to email content or related information may occur when reasonably necessary to:
- provide technical support;
- investigate security incidents;
- investigate abuse or fraud;
- troubleshoot the Service;
- comply with legal obligations;
- respond to valid legal requests; or
- protect SimploMail, our customers, or third parties.
We may also process message headers, metadata, logs, authentication information, and other technical information as necessary to provide, operate, maintain, and secure the Service.
17. Security
We use reasonable technical and organizational measures intended to protect the Service and information processed through it.
Email may be encrypted in transit using TLS when supported by the systems involved.
However, no Internet service or security system can be guaranteed to be completely secure.
You are responsible for protecting your passwords, authentication credentials, devices, and email applications.
You should notify us promptly if you believe that your account has been compromised.
18. Your Responsibilities
You are responsible for your use of Inbox and for the content of messages sent through your account.
You are also responsible for:
- maintaining control of your domain;
- maintaining accurate account information;
- protecting your account credentials;
- configuring your email client correctly;
- complying with applicable laws;
- obtaining any required permissions or consents;
- maintaining copies of important email; and
- ensuring that anyone you authorize to use your account complies with these Terms.
If you allow another person to access your account, you remain responsible for their activity.
19. Third-Party Services and Infrastructure
Inbox depends on third-party infrastructure, networks, domain name systems, payment processors, Internet service providers, email providers, and other services.
Third-party systems may experience outages, delays, failures, filtering, security incidents, or other problems.
SimploMail is not responsible for third-party services that are outside our reasonable control.
20. Fees and Subscriptions
Inbox is offered through paid subscriptions unless we expressly state otherwise.
The current subscription options and prices are displayed on the Inbox website or during the purchase process.
Subscriptions may be offered on monthly or annual billing periods.
If you purchase a recurring subscription, it will automatically renew for the applicable renewal period unless you cancel it before renewal.
The applicable price, billing period, and renewal terms will be presented to you before you complete your purchase.
21. Payment Processing
Payments may be processed by third-party payment providers.
You authorize the applicable payment provider to charge your selected payment method for the fees associated with your subscription.
SimploMail does not need to store your full payment card information when payment processing is handled by a third-party payment provider.
You are responsible for providing a valid payment method and keeping your billing information current.
22. Taxes
Applicable sales taxes, value-added taxes, or other government charges may be added to the subscription price where required by law.
You are responsible for applicable taxes associated with your purchase, except taxes imposed on SimploMail's income.
23. Price Changes
We may change our prices or subscription plans from time to time.
If a price change affects an existing recurring subscription, we will provide reasonable advance notice where required by applicable law.
Where required by law, you will have the right to cancel before the new price applies.
24. Cancellation
You may cancel your subscription using the cancellation method made available by SimploMail.
Cancellation normally prevents the next renewal.
Unless otherwise required by applicable law or expressly stated at the time of purchase, cancellation does not automatically entitle you to a refund for a billing period that has already started.
Your Service may continue until the end of the paid subscription period unless we suspend or terminate it earlier under these Terms.
25. Refunds
Refunds are subject to the refund terms presented at the time of purchase and applicable law.
Unless otherwise stated or required by law, subscription fees for a billing period that has already started are generally non-refundable.
Nothing in these Terms limits any refund, cancellation, or other consumer rights that cannot legally be waived.
We may refuse discretionary refunds where an account was suspended or terminated because of fraud, abuse, violation of these Terms, or unlawful activity.
26. Failed Payments
If a payment fails, we may attempt to collect the outstanding amount again or ask you to update your payment method.
We may suspend or restrict the Service if payment remains outstanding.
If your subscription is terminated because payment is not received, your email address may become unavailable.
27. Suspension and Termination
We may suspend or terminate your account, email address, or access to Inbox if we reasonably believe that:
- you violated these Terms;
- you violated applicable law;
- your account is being used for spam or phishing;
- your account is involved in fraud or abuse;
- your account presents a security risk;
- your domain is unauthorized or disputed;
- your payment obligations are not satisfied;
- your activity threatens the security, reputation, or operation of the Service;
- we receive credible reports of serious abuse; or
- suspension or termination is necessary to comply with a legal obligation.
We may take immediate action without prior notice when reasonably necessary to address an urgent security, abuse, fraud, legal, or operational risk.
Where appropriate and reasonably possible, we may provide notice and an opportunity to resolve the issue.
We may not disclose details of an investigation when doing so could compromise security, an investigation, or another person's rights.
28. Effect of Termination
When your account or subscription is terminated, your right to use Inbox ends.
We may disable the associated email address.
Messages that remain on SimploMail infrastructure may be deleted according to our normal operational procedures.
Information may remain temporarily in backups, logs, security systems, or other operational systems.
We may retain information when reasonably necessary to:
- comply with law;
- resolve disputes;
- prevent fraud or abuse;
- investigate security incidents;
- enforce these Terms; or
- protect our legal rights.
You are responsible for obtaining any information you need before your Service ends.
29. What Happens to Your Email Address
After your subscription ends or your account is terminated, SimploMail is not required to continue providing the email address.
The address may eventually become available for reuse, subject to our policies and technical availability.
We do not guarantee that you will be able to recover the same address after cancellation or termination.
You are responsible for updating services and contacts that use your Inbox email address before your subscription ends.
30. Intellectual Property
The Service, including its software, infrastructure, interfaces, branding, logos, designs, and other materials provided by SimploMail, is owned by or licensed to SimploMail and protected by applicable intellectual-property laws.
These Terms do not transfer ownership of SimploMail intellectual property to you.
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the Service except where applicable law expressly permits it.
31. Feedback
If you provide suggestions, ideas, feature requests, or other feedback about Inbox, you agree that SimploMail may use that feedback without restriction and without owing you compensation.
Providing feedback does not transfer ownership of your other intellectual property to SimploMail.
32. Service Availability
We try to keep Inbox available and operational, but we do not guarantee uninterrupted or error-free service.
The Service may be unavailable or restricted because of:
- maintenance;
- upgrades;
- security incidents;
- infrastructure failures;
- network failures;
- abuse prevention;
- legal requirements;
- third-party outages;
- DNS problems;
- cyberattacks; or
- other circumstances outside our reasonable control.
We do not provide a service-level agreement unless a separate written agreement expressly states otherwise.
33. Events Outside Our Reasonable Control
We are not responsible for delays, interruptions, failures, or losses caused by circumstances outside our reasonable control.
These circumstances may include natural disasters, severe weather, war, terrorism, government action, Internet failures, telecommunications failures, power outages, cyberattacks, infrastructure failures, third-party service failures, labour disputes, or other events that we could not reasonably prevent or control.
34. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Inbox is provided on an "as is" and "as available" basis.
We do not guarantee that Inbox will:
- be uninterrupted;
- be error-free;
- meet every particular business requirement;
- be available at all times;
- successfully send or receive every email;
- deliver every message;
- prevent every spam or malicious message;
- preserve every message; or
- recover every message after it has been removed.
We do not guarantee that an email sent from your Inbox address will reach the recipient's inbox or avoid spam filtering.
Nothing in these Terms excludes a warranty, condition, right, or remedy that cannot legally be excluded or limited.
35. Limitation of Liability
To the maximum extent permitted by applicable law, SimploMail and its directors, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes, without limitation, losses relating to:
- lost profits;
- lost revenue;
- lost business opportunities;
- lost goodwill;
- loss of data;
- loss of email;
- email delivery failures;
- message delays;
- spam filtering;
- account suspension;
- account termination;
- unauthorized access;
- service interruptions;
- third-party services; or
- costs of obtaining replacement services.
To the maximum extent permitted by applicable law, SimploMail's total aggregate liability arising from or relating to the Service or these Terms will not exceed the greater of:
- the total amount you paid to SimploMail for the Service during the 12 months immediately before the event giving rise to the claim; or
- CAD $100.
This limitation applies regardless of the legal theory on which a claim is based, including contract, negligence, tort, statute, or otherwise.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
36. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless SimploMail and its directors, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and reasonable expenses arising from or relating to:
- your use of Inbox;
- your violation of these Terms;
- your violation of applicable law;
- your email content;
- your domain or domain-related activity;
- unauthorized activity through your account for which you are responsible; or
- your violation of another person's rights.
You are not required to indemnify SimploMail for losses resulting from SimploMail's own conduct to the extent such indemnification would be prohibited by applicable law.
37. Legal Requests and Disclosure of Information
We may disclose information when we reasonably believe disclosure is necessary to:
- comply with applicable law;
- respond to valid legal process;
- protect the rights or safety of SimploMail, our customers, or others;
- investigate fraud, abuse, or security incidents; or
- enforce these Terms.
Where legally permitted, we may provide notice of legal requests affecting your information.
We may not provide notice where prohibited by law or where doing so could interfere with an investigation, security measure, or legal process.
38. Changes to the Service
We may change, improve, suspend, or discontinue parts of Inbox from time to time.
We may make changes without advance notice when reasonably necessary for security, abuse prevention, legal compliance, infrastructure protection, or other urgent operational reasons.
For material changes that negatively affect an existing paid service, we will provide reasonable notice where appropriate and required by law.
39. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we will provide reasonable notice where required by applicable law.
The updated Terms will become effective on the date stated in the updated Terms.
Your continued use of Inbox after the effective date means that you accept the updated Terms, except where applicable law requires a different form of acceptance.
If you do not agree to the updated Terms, you may stop using Inbox and cancel your subscription.
Nothing in this section limits any rights you may have under applicable consumer-protection law.
40. Privacy Policy and Other Policies
Our Privacy Policy and any other policies expressly incorporated into these Terms form part of your agreement with SimploMail.
If there is a conflict between these Terms and another SimploMail policy, these Terms control unless the other policy expressly states that it takes precedence.
41. Electronic Communications
You agree that SimploMail may communicate with you electronically regarding your account, subscription, security, Service changes, support requests, and other matters relating to Inbox.
Electronic communications may include email, notices displayed through the Service, or other reasonable electronic methods.
You are responsible for keeping the email address associated with your account current.
Where applicable law requires a communication to be provided in a particular form, we will provide it in the form required by law.
42. Notices
Notices from SimploMail may be sent to the email address associated with your account, displayed through the Service, or provided through other reasonable electronic means.
You may contact SimploMail through:
https://simplomail.com/contact
43. No Waiver
If SimploMail does not immediately enforce a provision of these Terms, that does not mean that SimploMail has waived its right to enforce that provision later.
Any waiver must be made in writing by an authorized representative of SimploMail.
44. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.
45. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where such restriction is prohibited by applicable law.
SimploMail may assign or transfer these Terms, including in connection with a merger, acquisition, corporate reorganization, sale of assets, or similar transaction.
46. Relationship of the Parties
These Terms do not create a partnership, joint venture, agency, employment relationship, franchise, or other similar relationship between you and SimploMail.
Neither party has authority to bind the other except as expressly stated in these Terms.
47. No Third-Party Beneficiaries
Except for SimploMail's directors, officers, employees, contractors, and service providers where expressly stated in these Terms, these Terms do not create rights for third parties to enforce any provision.
48. Entire Agreement
These Terms, together with the Privacy Policy and any other policies expressly incorporated into them, constitute the agreement between you and SimploMail concerning your use of Inbox.
They replace any prior agreements concerning the same Service, except for any separate written agreement expressly entered into between you and SimploMail.
49. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.
Subject to any rights that cannot legally be waived, courts located in Ontario will have jurisdiction over disputes arising from or relating to these Terms or the Service.
Nothing in this section is intended to prevent a consumer from exercising rights or bringing a claim in another jurisdiction where applicable law gives that consumer such a right.
50. Survival
Provisions that by their nature should continue after termination will survive termination of these Terms.
These include provisions relating to intellectual property, content rights, privacy, payment obligations, disclaimers, limitation of liability, indemnification, legal requests, governing law, and other provisions that are intended to survive termination.
